DESCRIPTION


The Compliance Lunch Debate, titled “Product Advertising & Consumer Protection”, will address the growing challenge of aligning product design and advertising with consumer protection in a landscape shaped by evolving regulations and digitalisation.


In practice, institutions are increasingly confronted with the overlap between general consumer protection rules and sector-specific requirements (MiFID, IDD, Consumer Credit Directive, PSD/PSR, National Acts & Decrees). This makes it more complex to determine which framework applies and how to ensure consistent, compliant and effective advertising across products and distribution channels.


European and national supervisors are raising the bar. They look closely at how key information is presented, how products are combined and priced, how digital channels are used, and whether marketing matches the contract and the product actually sold. The shift is towards outcome-based supervision: formal compliance is no longer enough, institutions must show that their communications are fair, clear and not misleading in practice.


Alongside the other speakers, a representative of the FSMA's Auditor's office will, for the first time in this series, walk us through the enforcement cases of recent years: which breaches led to proceedings, what the investigations revealed, and what institutions can learn from them.
